1. Acceptance

By creating an account, accessing or using Tourin, you accept these Terms and Conditions. If you do not agree, do not use the app. These terms are complemented by our Privacy Policy.

2. What Tourin Is

Tourin is a mobile app for exploring points of interest, maps, routes, stamps, a digital passport, achievements and visit statistics. Tourist, cultural, geographic, schedule, price, access or availability information may change and may come from third parties or public sources.

Tourin does not replace official instructions, signage, safety rules, actual site conditions or your own judgment.

3. User Account

Some features require an account. You must provide truthful, current and personal information. You are responsible for keeping your credentials confidential and for activity under your account.

We may suspend or close accounts that breach these terms, affect service security, use false data, attempt to access third-party information or engage in technical abuse.

4. Age And Minors

If you are under 14, you must have authorization from your parent or legal representative to use Tourin and for us to process your personal data, unless otherwise allowed by law.

If you are between 14 and 17, you may use Tourin subject to these terms, the Privacy Policy and special rules protecting children and teenagers. Tourin may apply enhanced protections, limit certain features or request additional authorization where appropriate.

5. Permitted Use

You may use Tourin for personal, tourism, educational or recreational purposes. You may not:

Use the app for illegal, abusive, fraudulent or harmful purposes.

Attempt to access accounts, systems, data or services that do not belong to you.

Manipulate location, stamps, achievements, statistics or security mechanisms.

Copy, scrape, resell or commercially exploit Tourin content without authorization.

Interfere with the operation of the app, servers, providers or APIs.

Upload or share unlawful, offensive, misleading, discriminatory or infringing content if those features are enabled.

6. Location, Maps And Visits

Some features require location permission to show your position, center the map or validate proximity to a tourist point. Location may be inaccurate due to GPS, device, network, environment or other technical conditions.

You must respect laws, signage, opening hours, private property, safety rules and actual site conditions. Tourin does not guarantee that a site is open, safe, accessible, free or suitable for everyone.

7. Content, Routes And External Links

Tourin may display information, images, routes, external websites or links to third-party services such as maps, navigation, Supabase, PostHog or other providers. We do not control all external content or services and are not responsible for their changes, availability, accuracy, policies or practices.

8. Sharing Features

If you share stamps, images or content from Tourin to other apps, you are responsible for what you publish and for following those platforms’ rules. Tourin does not control posts made outside the app.

9. Intellectual Property

Tourin, its brand, design, software, interfaces, text, icons, images, databases, routes and proprietary content belong to Tourin/Dolmen or its licensors. We grant you a limited, revocable, non-exclusive and non-transferable license to use the app under these terms.

You do not acquire rights over the app or its content except for this limited personal-use license.

10. Privacy

Personal data processing is governed by Tourin’s Privacy Policy. By using the app, you acknowledge that we may process data needed to provide the service, maintain security, operate location features, manage accounts, record visits and improve the experience, always according to applicable law.

11. Availability And Service Changes

We may modify, suspend or discontinue Tourin features due to maintenance, security, improvements, legal requirements, provider changes or operational reasons. We will try to avoid unnecessary interruptions, but we do not guarantee continuous or error-free availability.

12. Free Services And Future Paid Features

Tourin is currently offered without direct charge to the user, unless expressly stated otherwise. If paid features are added in the future, prices, terms, withdrawal rights where applicable, payment methods, renewals, cancellations and taxes must be disclosed before purchase.

13. Consumer Rights

Nothing in these terms limits non-waivable rights you may have under applicable law, including Chilean Law No. 19,496 on consumer protection where applicable. You may have rights to truthful and timely information, consumption safety, no arbitrary discrimination and legally available remedies.

14. Disclaimers And Liability

Tourin is provided “as is” and “as available,” to the extent permitted by law. We do not guarantee that information will always be complete, accurate or current, or that the app will operate without interruptions.

We are not responsible for travel decisions, accidents, damages, losses, costs, route changes, site closures, weather conditions, third-party acts, connectivity issues, device failures or misuse of the app. This limitation does not exclude liability that cannot be limited by law.

15. Termination

You may stop using Tourin at any time and request account deletion under the Privacy Policy. We may terminate or restrict your access if you breach these terms or if needed to protect users, third parties, the app or the law.

16. Changes

We may update these terms. Material changes will be communicated through reasonable means, such as the app or email. Continued use after changes take effect means acceptance, unless the law requires another form of consent.

17. Governing Law And Jurisdiction

These terms are governed by the laws of the Republic of Chile, without prejudice to mandatory consumer protection, personal data or other laws applicable according to the user’s place of residence. Any dispute will be heard by the competent courts under applicable law.
